Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using our website or services. By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree, do not use our website or services.

1. Company Overview

MoveSafe Relocation is a trade name (DBA) of EVERSAFE MOVING AND STORAGE LLC, a licensed household goods broker registered with the Federal Motor Carrier Safety Administration (FMCSA). MoveSafe is not a motor carrier. We do not own or operate moving trucks and do not physically transport household goods. We arrange for the transportation of your household goods by FMCSA-authorized motor carriers whose charges are determined by their published tariffs. The motor carrier — not MoveSafe — is responsible for the physical transportation, loading, unloading, and care of your household goods.

2. Eligibility

You must be at least 18 years old and capable of entering into a binding legal agreement to use our services. By using our website or submitting a quote request, you represent that you meet these requirements and that all information you provide is accurate and complete.

3. Services

MoveSafe provides household goods brokerage services, which include receiving and processing moving quote requests, providing estimates based on the information you supply, matching you with FMCSA-authorized motor carriers, and coordinating communications between you and the assigned carrier. Estimates are not guaranteed prices. Estimates are based on the information you provide and the carrier's published tariff. Final charges are determined by the carrier based on actual weight, distance, and services rendered. The carrier is required to make its tariff available for public inspection upon request.

4. Your Responsibilities

You agree to provide accurate, complete, and current information when submitting a quote request or booking a move, including a truthful inventory of household goods. You are responsible for reviewing and understanding the carrier's bill of lading, tariff, and any binding or non-binding estimate provided by the carrier. MoveSafe is not responsible for inaccuracies in quotes or estimates resulting from incomplete or inaccurate information you provide.

5. Carrier Relationship

When a carrier is assigned to your move, your contractual relationship for transportation services is directly with that carrier, not with MoveSafe. The carrier's own terms, conditions, tariff, and liability provisions govern the transportation of your household goods. MoveSafe will provide you with the name, MC number, and U.S. DOT number of any carrier assigned to your move, as required by 49 CFR § 371.109. MoveSafe exercises reasonable care in selecting FMCSA-authorized carriers but does not guarantee or warrant any carrier's performance, conduct, timeliness, quality of service, or pricing.

6. Consumer Protection Information

As required by federal law (49 CFR § 371.111), MoveSafe will provide you with the following FMCSA publications before your move: - "Ready to Move? — Tips for a Successful Interstate Move" - "Your Rights and Responsibilities When You Move" These publications are available at https://www.fmcsa.dot.gov/protect-your-move. By agreeing to access these documents online, you acknowledge receipt. If you would like printed copies, please contact us.

7. Deposits, Cancellation, and Refunds

Deposits: MoveSafe may require a deposit to reserve your move date and secure a carrier. The deposit amount and terms will be disclosed to you in writing before any payment is collected. Cancellation: You may cancel your move by contacting us in writing (email or text). Cancellation policies, including any applicable fees, will be disclosed to you at the time of booking. Refunds: If you cancel before the carrier's scheduled pickup, any refundable portion of your deposit will be returned to your original payment method within 14 business days. Specific refund terms will be provided to you at booking. All cancellation and refund policies are prominently displayed on our website as required by 49 CFR § 371.117.

8. Payment Terms

Deposits and brokerage fees are collected by MoveSafe. All payments to MoveSafe are for brokerage services only and are separate from any charges assessed by the motor carrier for transportation services. Carrier charges are paid directly to the carrier according to its tariff and payment terms. Payments are processed through our PCI DSS-compliant payment processor. We do not store full credit card numbers on our servers.

9. Communications Consent

By providing your phone number and submitting a quote request, you consent to receive phone calls and recurring SMS text messages from MoveSafe Relocation related to your moving quote and services. This includes follow-up calls and texts after missed calls, appointment reminders, and messages from our sales team regarding your move. Message frequency varies. Message and data rates may apply. Consent to receive calls or text messages is not a condition of purchasing any services. You may opt out of text messages at any time by replying STOP to any message. Reply HELP for assistance. 10. Intellectual Property

All content on our website — including text, graphics, logos, images, and software — is the property of MoveSafe Relocation or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our website for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, create derivative works from, or commercially exploit any content without our prior written consent.

11. Prohibited Conduct

You agree not to: - Provide false, misleading, or incomplete information in any quote request or communication - Use our website or services for any unlawful purpose - Attempt to gain unauthorized access to our systems, accounts, or data - Use automated tools (bots, scrapers, crawlers) to access or collect data from our website - Interfere with the operation or security of our website - Impersonate any person or misrepresent your affiliation with any entity

12. Disclaimer of Warranties

THE SERVICES AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MoveSafe does not warrant that the website will be uninterrupted or error-free, that any carrier will perform satisfactorily, or that estimates will match final carrier charges. MoveSafe's role is limited to arranging transportation and does not extend to the carrier's performance. To the extent any jurisdiction does not allow the exclusion of certain warranties, the above exclusions apply to the fullest extent permitted by applicable law.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOVESAFE'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE TOTAL FEES YOU PAID TO MOVESAFE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. MoveSafe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of or damage to household goods, delays in pickup or delivery, lost profits, or emotional distress, regardless of whether such damages were foreseeable. All claims for loss, damage, or delay to household goods must be directed to the motor carrier, not MoveSafe. Carriers are required to offer arbitration for loss and damage claims under 49 CFR § 375.211.

14. Indemnification

You agree to indemnify, defend, and hold harmless MoveSafe, its officers, directors, employees, and agents from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your provision of inaccurate or incomplete information, your use of our services, or any dispute between you and a motor carrier, except to the extent caused by MoveSafe's own gross negligence or willful misconduct.

15. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court. Agreement to Arbitrate: You and MoveSafe agree that any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and not by a court or jury, except that either party may bring claims in small claims court if they qualify. Class Action Waiver: You and MoveSafe agree that any arbitration or court proceeding shall be conducted on an individual basis only. Neither party may participate in a class action, class arbitration, or other representative proceeding. You waive any right to bring or participate in any class, consolidated, or representative action. Opt-Out Right: You may opt out of this arbitration agreement by sending written notice to MoveSafe within 30 days of first accepting these Terms. Your notice must include your name, address, phone number, and a clear statement that you wish to opt out of the arbitration provision. Costs: MoveSafe will pay all arbitration filing fees and arbitrator costs exceeding the amount you would pay to file a claim in court. Each party bears its own attorneys' fees unless the arbitrator awards fees to the prevailing party under applicable law. Location: Arbitration will take place in the county where you reside or where services were rendered, at your election.

16. Force Majeure

MoveSafe shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, severe weather, pandemics, government actions or orders, strikes or labor disputes, carrier insolvency or cancellation, fuel shortages, transportation disruptions, cyberattacks, or utility failures. In such events, our obligations will be suspended for the duration of the event, and we will use reasonable efforts to resume performance as soon as practicable.

17. FMCSA Complaints

If you have a complaint about a motor carrier's service, you may file a complaint with the FMCSA's National Consumer Complaint Database at https://nccdb.fmcsa.dot.gov or by calling 1-888-DOT-SAFT (1-888-368-7238). You retain all private rights of action under 49 CFR § 371.121.

18. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles, except where superseded by federal law (including the Federal Arbitration Act) or where a state's consumer protection laws require application of that state's law to its residents.

19. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will post the revised Terms on our website with an updated effective date. Your continued use of our website or services after the effective date constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MoveSafe regarding your use of our website and services, and supersede all prior agreements and understandings.
